Terms of Use

1. The agreement
These Terms are the agreement between you and RADIAL DATA SERVICES LTD, registered in England and Wales at 3rd Floor, 86-90 Paul Street, London EC2A 4NE, for use of the Fortify VPN+ iPhone app. Install it or use it and these Terms apply to you. If that does not suit you, remove the app. Purchases are also covered by Apple's App Store terms, and our handling of data is set out in the Privacy Policy.
2. Your licence
We grant you a personal, non-transferable, revocable licence to use the app on Apple devices you own or control, on the terms Apple sets for the App Store. The app stays ours. You may not copy it, sell or rent access to it, take it apart, reverse engineer it, or strip notices out of it, except where the law says such a restriction cannot be applied.
3. What the app is not
Fortify VPN+ encrypts the connection between your device and the server you select. It is not antivirus software, it does not scan your device, it does not remove malware, and no VPN can make you anonymous or protect you from every risk online. Nothing in the app should be read as a promise of that.
4. Acceptable use
Use the connection lawfully. In particular, do not use it to break a law that applies to you or help anyone else do so, to attack or disrupt networks and services, to send spam or malware, to infringe intellectual property, or to distribute unlawful material. Bypassing these Terms through automated means counts as a breach of them.
5. Subscriptions
Downloading costs nothing. Everything the app can do is unlocked by an auto-renewable subscription, whose length and price appear on screen in your own currency before you confirm anything, and differ from country to country. Apple charges your Apple Account when you confirm, and again within the 24 hours before each new period begins, at the price of the plan you chose. Renewal continues until you turn it off.
6. Cancelling
Cancel in your Apple Account settings, under Subscriptions. Do it at least 24 hours before the current period ends, otherwise the next period is charged. Cancelling stops future renewals and leaves your access running to the end of the period already paid for. Deleting the app does not cancel a subscription. Where a free trial is offered, the unused part of it ends when a subscription is purchased.
7. Refunds
Apple processes App Store purchases, so Apple decides refunds under its own policies. Requests go to reportaproblem.apple.com. Rights you have under consumer law where you live are unaffected by this. If you think a charge is wrong, write to us as well: we cannot issue the refund, but we can check what happened.
8. Outside services
Two services outside our control take part in the app. Apple handles distribution, billing and subscription status. Have I Been Pwned answers the email leak check when you choose to run one. Each operates under its own terms and privacy notice, and we are not responsible for how they run their services.
9. Changes to the app
We develop the app continuously, so features may be added, changed or withdrawn, and server locations may come and go. Where a change materially reduces what a paid subscription gives you, you can cancel as described above. These Terms may also change; the current version always sits on this page with the date at the top.
10. Ending access
We may suspend or end access where you breach these Terms or where the law requires it. You can stop at any time by cancelling the subscription and deleting the app.
11. No warranty
The app is provided as it is and as available. So far as the law allows, we exclude implied warranties, including fitness for a particular purpose and non-infringement. Connection quality depends on your network and on the location you pick, and we do not promise uninterrupted or error-free service.
12. Liability
So far as the law allows, we are not liable for indirect, incidental, special or consequential loss, or for lost data, profit or business arising from your use of the app. Where liability cannot be excluded at all, it is capped at the amount you paid us for the app during the twelve months preceding the event behind the claim. Nothing here limits liability that the law does not permit us to limit, including for death or personal injury caused by negligence, or for fraud.
13. Apple's role
This agreement is between you and us, not with Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide support for the app. If the app fails to conform to a warranty that cannot be excluded, you may notify Apple, and Apple may refund the purchase price; beyond that, Apple has no warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
14. Governing law
These Terms are governed by the laws of England and Wales. Mandatory consumer protection rules of the country where you live still apply to you, and nothing here takes them away.
